Terms and Conditions
In order to participate in any of Premier Hoops / Premier Hoops Corporation Programs and Training every athlete (participant), participant’s parent or legal guardian or any person affiliated with the participant must agree with Terms & Conditions of Premier Hoops / Premier Hoops Corporation which consist of Medical Authorization, General Release of Liability, Media Release, Refund, Credit, Cancellation, Ethics and Privacy Policies.
Medical Authorization: Copies of immunization records and a health history are required to be on file for each participant prior to the start any of Premier Hoops Programs. It is a Parent’s responsibilities to make sure that Premier Hoops have immunization records and a health history of participant. Parents will need to give written explanation of any medical condition or allergies the participants might have to Premier Hoops staff. Participant’s parent or legal guardian permits the treatment of injuries or other damages. Participant’s parent or legal guardian hereby give permission for participant at Premier Hoops programs to be directed (by Premier Hoops Staff Member) to be examined by a licensed physician or be directed to a hospital or clinic to secure proper treatment, anesthesia, or surgery in the event of an emergency.
GENERAL RELEASE OF LIABILITY DURING TRANSPORTATION AND PARTICIPATION OF BASKETBALL RELATED ACTIVITIES, PROGRAMS, TRAINING AND EVENTS:
By participating with any of Premier Hoops basketball related physical activities, programs, training and events and during the transportation to these activities or any events “Activities” participant and the participant’s parent/legal guardian and or any affiliated with the participant person hereby acknowledge their awareness that participation with these Activities or any events may expose participant to certain foreseeable and unforeseeable risks of damage and/or bodily injury, including serious bodily injury, where I may need to be hospitalized.
Participant and the participant’s parent/legal guardian and or any affiliated with the participant person knowingly, freely and voluntarily assume all risks and engage myself in the participation of the above-mentioned Activities.
In consideration of participation in Activities that are hosted by Premier Hoops:
Participant and the participant’s parent/legal guardian and or any affiliated with the participant person hereby release Premier Hoops, its coaches, staff, owners, managers, officers and independent contractors from any and all liability arising out my participation of the above mentioned Activities and during the transportation to these activities and events and hereby waive my rights herein to assert any claim(s) for damages, bodily injury or serious bodily injury to the fullest extend allowed by law.
Participant and the participant’s parent/legal guardian and or any affiliated with the participant person further agree that Participant and the participant’s parent/legal guardian and or any affiliated with the participant person will hold harmless Premier Hoops, its coaches, staff, owners, managers, officers and independent contractors against any and all claim(s) for damages, bodily injury or serious bodily injury arising out of or in connection of participation in the above mentioned Activities and during the transportation to these Activities and events whether caused by negligence or otherwise.
Participant and the participant’s parent/legal guardian and or any affiliated with the participant person fully understand the terms set forth in this General Release Form, and Participant and the participant’s parent/legal guardian and or any affiliated with the participant person hereby execute this Release of Liability Form.
By participating with any of Premier Hoops / Premier Hoops Corporation programs and training and using any training facilities, the participant and or any person affiliated with the participant does so at his/her own risk. The participant and/or the participant’s parent/legal guardian and or any affiliated with the participant person acknowledge that Premier Hoops / Premier Hoops Corporation is an active, physical program and that any type of injuries may occur. Premier Hoops / Premier Hoops Corporation, and its staff, independent contractors, management or any affiliates, shall not be liable directly or indirectly for any and all damages or any and all types of injuries to participant, or any person affiliated with the participant or property of the participant during its programs. The participant and his/her parent/legal guardian, or any affiliated with the participant person confirms that they carry a medical insurance coverage and shall assume full and all responsibility for any and all damages or any and all types of injuries to participant, or any person or property affiliated with the participant, which may occur to the participant or its parent or legal guardian or other person affiliated with participant during Premier Hoops / Premier Hoops Corporation programs and hereby fully and forever exonerate and discharge Premier Hoops, its facilities, and its staff, its owners, employees or independent contractors, and agents or any affiliates of Premier Hoops / Premier Hoops Corporation, from any and all claims, demands, damages, rights of action or causes of action, present or future, whether the same be known, anticipated or unanticipated, resulting from or arising out of the participant’s participation or any person affiliated with the participant in any of Premier Hoops / Premier Hoops Corporation programs and training and in the use of any facilities. The participant and/or parent/guardian or any person affiliated with the participant also agrees to defend, indemnify and hold harmless Premier Hoops / Premier Hoops Corporation and any training facilities, and their owners, employees, independent contractors and agent any affiliates of Premier Hoops / Premier Hoops Corporation from any and all losses, claims, penalties, demands, expenses or costs, including court costs and attorneys’ fees, arising from the participant’s participation in the training session and in the use of any facilities.
Media Release: The participant and/or the participant’s parent/guardian hereby authorizes Premier Hoops to utilize any and all information about participant including, but not limited to: Any media sources, Facebook, website’s affiliated with Premier Hoops and other information collected by Premier Hoops for use in promotion of youth athletics and in promotion of the Premier Hoops Programs.
Refund Policy:
Full refunds will not be provided under any circumstances.
Partial credit to a future Premier Hoops program and/or workout will be provided pursuant to the Credit Policy below for any notice of withdrawal provided to Premier Hoops less than thirty (30) days prior to the starting date of the enrolled program. All Refunds to Credit Cards will be charged 10% processing fees with $20.00 minimum. Participant understands that Premier Hoops will try to make equal and balanced teams at tournaments to give every player an opportunity to improve and succeed. Participant understands and agrees to play on the team the Participant has been assigned.
If any program was purchased at special or discounted prices, no refund will be provided.
All team and skills program deposits are non-refundable.
Participant must contact premierhoops@gmail.com at least 24 hours before attending an un-registered for program.
Premier Hoops does not have a universal refund policy for programs and/or tournaments which might be cancelled because of coronavirus. If practices or games end up never being conducted, participants might get a credit for future programs.
Credit Policy:
1/2 credit will be given when a participant notifies Premier Hoops in writing within 48 hours of the program that he/she cannot attend. When a participant is sick or injured a participant will need to notify in writing Premier Hoops within 24 and 48 hours of the workout time / date that he/she cannot make the workout in order to receive a credit. In this case proof from the doctor will be needed to be provided to receive a credit. No credit will be given if a participant notifies in writing Premier Hoops within less than 24 hours of the workout time/date and the participant would be still responsible to pay for the program. If participant misses the program he/she still is responsible to pay for the program.
Expiration: All credits must be applied to a future Premier Hoops program within six (6) months of the conclusion of the program for which a credit has accrued. All unused credits expire six (6) months from the conclusion of the program for which a credit has accrued. In order for a credit to accrue, the participant must have missed a minimum of two (2) sessions. Credits are not assignable or transferable, except amongst siblings.
Tournaments Policy:
All teammates rely on each other during the tournaments. A participant must commit to all games and cannot miss the tournament for any reasons except being sick and physically unable to come. In this case a participant must notify in writing to Premier Hoops not less than 24 hours prior to the tournament that he/she cannot make the tournament. Proof from the doctor should be accompanied with written notification. Violation of the tournaments policy might result in suspension of the participant or removal from the team.
Cancellation Policy:
All orders are final once they are placed unless participant provides Premier Hoops with written notification more than thirty (30) days prior to the start of the program for which they are enrolled of their decision to withdraw from the program.
All programs offered by Premier Hoops are subject to change in location, time or date.
Ethics Policy:
We at Premier Hoops are committed to being a good corporate citizen, taking account of the economic, social and environmental impact of our business and aiming to maximize the benefits and minimize any negative impact of our operations.
We at Premier Hoops are fully committed to high ethical standards in our business dealings to ensure the integrity of our Trainers/Coaches and our organization is maintained.
Trainers/Coaches should not accept gifts, money or entertainment from Participant’s parent or legal guardian or other individuals without written permission of Premier Hoops management.
Trainers/Coaches during its Employment/contracting with Premier Hoops cannot offer any private basketball services to any Company’s Clients.
Participant’s parent or legal guardian engaged in accepting of private basketball services from Premier Hoops Trainers/Coaches are fully financially liable to repay Premier Hoops the exact amount they have already paid to Premier Hoops Trainers/Coaches.
Participants behavior that disturbs other participants from learning and any activities such as fighting or using abusive language will be escorted off the court to the “bench”, at which time they will be spoken with. Premier Hoops Staff will explain why their actions were inappropriate. If a Participant continues to use behavior that is considered inappropriate, personnel will speak with the parents or legal guardian about their child’s behavior. Premier Hoops Staff will explain the problem and why we do not condone this behavior. If a Participant continues to use behavior that is considered inappropriate, after personal have spoken with both the Participant and the parent or legal guardian, that Participant will then be expelled from the program. Premier Hoops Staff will call the Participant’s parents and have them come and pick-up their child. No refunds will be provided.

- Social Media Information. If you engage with the Services through social media services or other third-party platforms, such as Facebook, the PH may have access to certain Information in your profile depending on your privacy settings.

- Provide the Services
- For any specific purpose for which it was provided or volunteered.
- To send you information
- To Prevent fraud and defend legal rights
- To comply with applicable law
DISCLOSURE OF INFORMATION
PH may share your information with:
- Service providers that perform certain business-related functions on its behalf
- Social Networks: if you use social networks through the services.
- As required by law in with Law Enforcement Agencies or Regulators.
PH will not share any of your information requested by any third parties.
HOW LONG WE RETAIN YOUR DATA
For users that register on our website (if any), we also store the personal information they provide in their user profile if they provided that information. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.
Information is retained only for time services is provided and get deleted after the particular program / training session ends.
